ARTICLE 2. SCOPE OF APPLICATION. This manual will apply to the processing of personal data collected and managed by J&P Jeans SAS

ARTICLE 3. PURPOSE. To protect and guarantee, based on this manual, the fundamental right to habeas data regulated by Law 1581 of 2012, which governs the procedures for the collection, management and processing of personal data carried out by J&P Jeans SAS.

ARTICLE 4. VALIDITY OF THE DATABASE. J&P Jeans SAS will apply the policies and procedures contained in this manual to the databases over which they have decision-making power, for a term equal to that established by statute for the duration of the company.

ARTICLE 5. PRINCIPLES FOR THE PROCESSING OF PERSONAL DATA. In the development, interpretation and application of this law, the following principles shall be applied in a harmonious and comprehensive manner:

d) Principle of transparency: In the Processing, the right of the Owner to obtain from the Controller at any time and without restrictions, information about the existence of data that concerns him/her must be guaranteed.

e) Principle of restricted access and circulation: Personal data, except for public information, may not be available on the Internet or other means of dissemination or mass communication, unless access is technically controllable to provide restricted knowledge only to the owners or authorized third parties.

f) Security principle: The information subject to Processing by the Controller must be handled with the technical, human and administrative measures necessary to ensure the security of the records, avoiding their adulteration, loss, consultation, use or unauthorized or fraudulent access.

g) Confidentiality principle: All persons involved in the processing of personal data that are not public in nature are obliged to guarantee the confidentiality of the information, even after their relationship with any of the tasks that comprise the processing has ended.

RIGHTS AND DUTIES

ARTICLE 6. RIGHTS OF DATA OWNERS. In accordance with the provisions of Law 1581 of 2012, the owner of personal data has the following rights:

Know, update and correct your Personal Data. With the right to exercise this right, among others, in relation to information that is partial, inaccurate, incomplete, divided, misleading or whose processing is prohibited or unauthorized.

Require proof of consent granted for the collection and processing of Personal Data.

Be informed by J&P Jeans SAS of the use that has been given to the Personal Data.

File complaints with the Superintendency of Industry and Commerce in the event that there is a violation by J&P Jeans SAS of the provisions of Law 1581 of 2012, Decree 1377 of 2013 and other regulations that modify, add to or complement them, in accordance with the provisions on the procedural requirement established in article 16 of Law 1581 of 2012.

Revoke the authorization granted for the processing of Personal Data.

Request to be removed from the database. This deletion or elimination involves the total or partial elimination of personal information as requested by the owner in the databases of J&P Jeans SAS.


It is important to note that the right to deletion is not absolute and the controller may deny the exercise of the right when: The owner has a legal and/or contractual duty to remain in the database, the deletion of the data hinders judicial or administrative proceedings or the investigation and prosecution of crimes, the data is necessary to comply with a legal obligation acquired by the owner.

Inform the Superintendency of Industry and Commerce when security code violations occur and there are risks in the management of the information of the Holders.

Comply with the instructions and requirements issued by the Superintendency of Industry and Commerce.

Insert into the database the legend "information under judicial discussion" once notified by the competent authority, regarding judicial processes related to the quality or details of personal data;

Refrain from circulating information that is being disputed by the owner and whose blocking has been ordered by the Superintendency of Industry and Commerce;

Allow access to information only to authorized persons.

Inform through the means it considers pertinent of the new mechanisms it implements so that the holders of the information can exercise their rights.

AUTHORIZATION AND PURPOSE

ARTICLE 8. AUTHORIZATION. J&P Jeans SAS, as the Data Controller, has provided the necessary mechanisms to obtain the authorization of the owners, ensuring in all cases that it is possible to verify the granting of said authorization.

ARTICLE 9. PURPOSE OF THE AUTHORIZATION. The processing of the personal data of the Holders will be carried out by J&P Jeans SAS for the following purposes: offering products and services and the sales network of its commercial goods, communicating information related to products, the acquisition of our goods and services, we collect the personal information you provide us, such as name, address and email. When you browse our store, we also automatically receive the address of the Internet Protocol (IP) equipment in order to provide us with information that helps us learn about your browser and operating system.

FINAL PROVISIONS

ARTICLE 15. VALIDITY. This policy is effective as of July 2022.
